The Act came into force on 9th December 2013 and applies to every workplace in India across all sectors, including private companies, startups, government departments, NGOs, hospitals, educational institutions, and domestic workplaces.<\/p>\n<p>The POSH Act stipulates that a woman shall not be subjected to sexual harassment at her workplace. Accordingly, it may be noted that for a woman to claim protection under the Act, the incident of sexual harassment should have taken place at the &#8220;workplace.&#8221;<\/p>\n<p>The POSH Act defines &#8216;sexual harassment&#8217; in line with the Supreme Court&#8217;s definition in the Vishaka Judgment. As per the Act, &#8216;sexual harassment&#8217; includes unwelcome sexually tinted behaviour, whether directly or by implication, such as:<\/p>\n<ul>\n<li>Physical contact and advances;<\/li>\n<li>Demand or request for sexual favours;<\/li>\n<li>Making sexually coloured remarks;<\/li>\n<li>Showing pornography; or<\/li>\n<li>Any other unwelcome physical, verbal, or non-verbal conduct of a sexual nature.<\/li>\n<\/ul>\n<p>The definition of &#8216;sexual harassment&#8217; under Section 2(n) of the Act is wide enough to cover both direct and implied sexual conduct, whether physical, verbal, or written. The Act covers both quid pro quo harassment (where compliance is linked to employment benefits or threats) and hostile work environment harassment (where behaviour creates an intimidating, offensive, or humiliating atmosphere). A single incident can constitute harassment if it meets the statutory threshold.<\/p>\n<p>The POSH Act mandates that all companies with more than 10 employees:<\/p>\n<ul>\n<li>Constitute the Internal Committee (IC); and<\/li>\n<li>Conduct POSH awareness among employees through training and by displaying posters on POSH, etc.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Governing_Laws_Rules\"><\/span><span style=\"color: #000080;\"><strong><u>Governing Laws &amp; Rules<\/u><\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul>\n<li>The Sexual Harassment of Women at Workplace (Prevention, Prohibition &amp; Redressal) Act, 2013 (&#8220;POSH Act&#8221;) was notified on 23rd April 2013.<\/li>\n<li>The Sexual Harassment of Women at Workplace (Prevention, Prohibition &amp; Redressal) Rules, 2013 were notified on 9th December 2013.<\/li>\n<\/ul>\n<p>The Act has three stated objectives \u2014 prevention, prohibition, and redressal. Prevention means stopping harassment before it occurs through awareness, policy, and training. Prohibition means enforcing zero tolerance, backed by defined consequences. Redressal means giving employees access to a fair, time-bound complaint mechanism.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Applicability_of_the_POSH_Act\"><\/span><span style=\"color: #000080;\"><strong>Applicability of the POSH Act<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Act applies broadly across:<\/p>\n<ul>\n<li>Private companies, startups, and multinational corporations;<\/li>\n<li>Central and state government departments and public sector undertakings;<\/li>\n<li>NGOs, hospitals, schools, and universities;<\/li>\n<li>Unorganised sector establishments; and<\/li>\n<li>Domestic workplaces employing domestic workers.<\/li>\n<\/ul>\n<p>Courts have consistently confirmed a broad interpretation of &#8220;workplace,&#8221; extending it to client sites, off-site events, field visits, and digital spaces such as official e-mail, messaging apps, and video calls.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"POSH_Compliance_Workplace_Safety_Advisory\"><\/span><span style=\"color: #000080;\"><a style=\"color: #000080;\" href=\"https:\/\/carajput.com\/archives\/posh-at-work-a-practical-guide.pdf\"><strong>POSH Compliance &amp; Workplace Safety Advisory<\/strong><\/a><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013 (&#8220;POSH Act&#8221;), was enacted to provide protection against sexual harassment of women at the workplace and to establish mechanisms for prevention, prohibition, and redressal of complaints. A Local Complaints Committee (LCC) is set up in each district to hear complaints from institutions with fewer than ten employees or where the complaint is against the employer himself.<\/p>\n<h4><span class=\"ez-toc-section\" id=\"Constituting_an_Internal_Complaints_Committee\"><\/span><span style=\"color: #000080;\"><strong><u>Constituting an Internal Complaints Committee<\/u><\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h4>\n<p style=\"padding-left: 40px;\">The POSH Act applies to Companies, LLPs, partnership firms, start-ups, educational institutions, hospitals, NGOs, government bodies, and professional organizations.
