and<\/p>\n<p><strong>d)<\/strong>\u00a0Services related to agro and allied sectors<\/p>\n<p><em>Note: Besides the above, FDI is not allowed in any other agricultural sector\/activity<\/em><\/td>\n<td width=\"129\">100%<\/td>\n<td width=\"128\">Automatic<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"For_companies_dealing_with_development_of_transgenic_seedsvegetables_the_following_conditions_apply_Other_Conditions\"><\/span><span style=\"color: #ff6600;\"><br \/>\nFor companies dealing with development of transgenic seeds\/vegetables, the following conditions apply:<strong>Other Conditions<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li>When dealing with genetically modified seeds or planting material the company shall comply with safety requirements in accordance with laws enacted under the Environment (Protection) Act on the genetically modified organisms.<\/li>\n<li>\u00a0Any import of genetically modified materials if required shall be subject to the conditions laid down vide Notifications issued under Foreign Trade (Development and Regulation) Act, 1992.<\/li>\n<li>The company shall comply with any other Law, Regulation or Policy governing genetically modified material in force from time to time.<\/li>\n<li>Undertaking of business activities involving the use of genetically engineered cells and material shall be subject to the receipt of approvals from Genetic Engineering Approval Committee (GEAC) and Review Committee on Genetic Manipulation (RCGM).<\/li>\n<li>Import of materials shall be in accordance with National Seeds Policy.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The term \u201cunder controlled conditions\u201d covers the following:<\/p>\n<ul style=\"text-align: justify;\">\n<li>\u2018Cultivation under controlled conditions\u2019 for the categories of floriculture, horticulture, cultivation of vegetables and mushrooms is the practice of cultivation wherein rainfall, temperature, solar radiation, air humidity and 41 culture medium are controlled artificially. Control in these parameters may be effected through protected cultivation under green houses, net houses, poly houses or any other improved infrastructure facilities where micro-climatic conditions are regulated anthropogenically.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">In case of Animal Husbandry, scope of the term \u2018under controlled conditions\u2019 covers \u2013<\/p>\n<ul style=\"text-align: justify;\">\n<li>Rearing of animals under intensive farming systems with stall-feeding. Intensive farming system will require climate systems (ventilation, temperature\/humidity management), health care and nutrition, herd registering\/pedigree recording, use of machinery, waste management systems as prescribed by the National Livestock Policy, 2013 and in conformity with the existing \u2018Standard Operating Practices and Minimum Standard Protocol.\u2019<\/li>\n<li>Poultry breeding farms and hatcheries where micro-climate is controlled through advanced technologies like incubators, ventilation systems etc.<\/li>\n<li>In the case of pisciculture and aquaculture, scope of the term \u2018under controlled conditions\u2019 covers \u2013 (a) Aquariums (b) Hatcheries where eggs are artificially fertilized and fry are hatched and incubated in an enclosed environment with artificial climate control.<\/li>\n<li>In the case of apiculture, scope of the term \u2018under controlled conditions\u2019 covers\u2013<\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li>Production of honey by bee-keeping, except in forest\/wild, in designated spaces with control of temperatures and climatic factors like humidity and artificial feeding during lean seasons.<\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Compliance_with_FEMA_Regulations\"><\/span><span style=\"color: #ff6600;\"><strong>Compliance with FEMA Regulations<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">A two-stage reporting procedure has to be followed :-<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"On_receipt_of_share_application_money\"><\/span><span style=\"color: #00ccff;\"><strong>On receipt of share application money<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Within 30 days of receipt of share application money\/amount of consideration from the non-resident investor, the Indian company is required to report to the Foreign Exchange Department, Regional Office concerned of the Reserve Bank of India, under whose jurisdiction its Registered Office is located, the Advance Reporting Form, containing the following details :<\/p>\n<ul style=\"text-align: justify;\">\n<li>Name and address of the foreign investor\/s;<\/li>\n<li>Date of receipt of funds and the Rupee equivalent;<\/li>\n<li>Name and address of the authorised dealer through whom the funds have been received;<\/li>\n<li>Details of the Government approval, if any; and<\/li>\n<li>KYC report on the non-resident investor from the overseas bank remitting the amount of consideration.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The Indian company has to ensure that the shares are issued within 180 days from the date of inward remittance which otherwise would result in the contravention \/ violation of the FEMA regulations.<\/p>\n<h3 style=\"text-align: justify;\"><span class=\"ez-toc-section\" id=\"Upon_issue_of_shares_to_non-resident_investors\"><\/span><span style=\"color: #00ccff;\"><strong>Upon issue of shares to non-resident investors:<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p style=\"text-align: justify;\">Within 30 days from the date of issue of shares, a report in Form FC-GPR- PART A together with the following documents should be filed with the Foreign Exchange Department, Regional Office concerned of the Reserve Bank of India.<\/p>\n<ul style=\"text-align: justify;\">\n<li>Certificate from the Company Secretary of the company accepting investment from persons resident outside India certifying that:<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The company has complied with the procedure for issue of shares as laid down under the FDI scheme as indicated in the\u00a0<a href=\"https:\/\/www.rbi.org.in\/Scripts\/BS_FemaNotifications.aspx?Id=174\">Notification No. FEMA 20\/2000-RB dated 3rd May 2000<\/a>, as amended from time to time.<\/p>\n<p style=\"text-align: justify;\">The investment is within the sectoral cap \/ statutory ceiling permissible under the Automatic Route of the Reserve Bank and it fulfills all the conditions laid down for investments under the Automatic Route,<\/p>\n<p style=\"text-align: justify;\">OR<\/p>\n<p style=\"text-align: justify;\">Shares have been issued in terms of SIA\/FIPB approval No. &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212; dated &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211; (enclosing the FIPB approval copy)<\/p>\n<ul>\n<li style=\"text-align: justify;\">Certificate from Statutory Auditors\/ SEBI registered Merchant Banker \/ Chartered Accountant indicating the manner of arriving at the price of the shares issued to the persons resident outside India.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The content of this article is intended to provide a general guide to the subject matter.
