{"id":412,"date":"2015-10-24T11:39:38","date_gmt":"2015-10-24T11:39:38","guid":{"rendered":"http:\/\/caindelhiindia.com\/blog\/?p=412"},"modified":"2021-07-07T13:21:10","modified_gmt":"2021-07-07T13:21:10","slug":"refund-procedure-of-service-tax-paid-on-input-service-notfn-412012-st","status":"publish","type":"post","link":"https:\/\/www.caindelhiindia.com\/blog\/refund-procedure-of-service-tax-paid-on-input-service-notfn-412012-st\/","title":{"rendered":"REFUND PROCEDURE OF SERVICE TAX PAID ON INPUT SERVICE &#8211; NOTFN 41\/2012-ST"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"color: #0000ff;\"><strong>REFUND PROCEDURE of SERVICE TAX\u00a0PAID ON INPUT SERVICE &#8211; NOTIFICATION 41\/2012-ST<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\">The Government of India issued a\u00a0Notification No. 41\/2012-Service Tax Date-29.06.2012 to enable the Exporter of Goods\/ services to claim the\u00a0SERVICE TAX\u00a0what ever they have paid to effect the export of goods beyond the place of removal ( Factory ) to the port of export.<\/p>\n<ul style=\"text-align: justify;\">\n<li style=\"text-align: justify;\"><strong><span style=\"color: #ff6600;\">PRE-NE<\/span><\/strong><strong><span style=\"color: #ff6600;\">GATIVE LIST:<\/span><\/strong> In<strong>\u00a0<\/strong>the pre-negative list regime as introduced w.e.f. 01.07.2012, the process of claiming refund of service tax paid on specified services by merchant exporters and manufacturer exporter of goods was governed by Notification No. 52\/2011-ST dated 30.12.2011. In the new regime, the said notification has been superseded by Notification No. 41\/2012-ST dated 29.06.2012 w.e.f. 01.07.2012. Therefore, henceforth any claim of refund\/rebate of service tax paid on input services used by merchant exporters and manufacturer exporter of goods would be governed by the clauses of Notification No. 41\/2012-ST. The salient features of the same are given below.<\/li>\n<li><strong><span style=\"color: #ff6600;\">DATE OF APPLICABILITY:<\/span><\/strong>The process under the new notification is to be followed for refunds beginning from July 1, 2012.<\/li>\n<li><strong><span style=\"color: #ff6600;\"> SPECIFIED SERVICES ELIGIBLE FOR REFUND<\/span><span style=\"color: #ff6600;\">: <\/span><\/strong>Since, w.e.f. 01.07.2012, service specific classification of services have been done away with and we have a single consolidated definition of the term &#8220;service&#8221; as defined under Section 65 B(44) of the Finance Act, 1994 as amended to date, the Notification lists down the definition of\u00a0specified servicesfor which refund can be claimed\u00a0on the basis of services used beyond the place of removal as eligible services for claiming refund of input service credit.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The extract of the relevant portion of the aforesaid notification is reproduced below:<\/p>\n<p style=\"text-align: justify;\"><em>&#8220;(i) In the case of excisable goods, taxable services that have been used beyond the place of removal, for the export of said goods;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>(ii) In the case of goods other than (i) above, taxable services used for the export of said goods;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>But shall not include any service mentioned in sub clause (A),(B),(BA) and (C) of clause (I) of rule (2) of the CENVAT Credit Rules,2004.&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">From the reading of the above clause it is clear that the following are eligible input services for claiming refund under the said notification:<\/p>\n<p style=\"text-align: justify;\"><em>All the services used beyond the place of removal other than those specific excluded from the definition of input service under Rule 2(l) of the Cenvat Credit rules, 2004 as amended to date.<\/em><\/p>\n<p style=\"text-align: justify;\">The services which form part of the\u00a0exclusion clause\u00a0of the definition are:<\/p>\n<table width=\"100%\">\n<tbody>\n<tr>\n<td>a. Construction of Complex services<\/td>\n<td><\/td>\n<\/tr>\n<tr>\n<td>b.\u00a0 Works contract service<\/td>\n<td><\/td>\n<\/tr>\n<tr>\n<td>c. Rent a cab operator service<\/td>\n<td><\/td>\n<\/tr>\n<tr>\n<td>d.\u00a0 General insurance service in relation to motor vehicle<\/td>\n<td><\/td>\n<\/tr>\n<tr>\n<td>e.\u00a0 Motor vehicle related services<\/td>\n<td><\/td>\n<\/tr>\n<tr>\n<td>f. Outdoor catering services<\/td>\n<td rowspan=\"9\">When used primarily for personal use or consumption of any employee<\/td>\n<\/tr>\n<tr>\n<td>g. Beauty treatment services<\/td>\n<\/tr>\n<tr>\n<td>h. Health services<\/td>\n<\/tr>\n<tr>\n<td>i. Cosmetic and plastic surgery services<\/td>\n<\/tr>\n<tr>\n<td>j. Membership of a club services<\/td>\n<\/tr>\n<tr>\n<td>k. Health and fitness centre services<\/td>\n<\/tr>\n<tr>\n<td>l. Life insurance<\/td>\n<\/tr>\n<tr>\n<td>m. Health insurance<\/td>\n<\/tr>\n<tr>\n<td>n. Travel benefit extended to employee on vacation<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<ul>\n<li style=\"text-align: justify;\">Now, the services which\u00a0can be claimed as eligible services\u00a0and used beyond the place of removal are:Clearing and forwarding agents services<\/li>\n<li style=\"text-align: justify;\">Courier services<\/li>\n<li style=\"text-align: justify;\">Custom house agents services<\/li>\n<li style=\"text-align: justify;\">Insurance business services in relation to General Insurance\u00a0Port services<\/li>\n<li style=\"text-align: justify;\">Storage and warehousing services<\/li>\n<li style=\"text-align: justify;\">Transport of coastal goods and transport of goods through national water way\/inland water services<\/li>\n<li style=\"text-align: justify;\">Transport of goods by air services<\/li>\n<li style=\"text-align: justify;\">Transport of goods by road services<\/li>\n<li style=\"text-align: justify;\">Terminal handling services<\/li>\n<li style=\"text-align: justify;\">Technical testing and analysis<\/li>\n<li style=\"text-align: justify;\">Technical inspection and certification services<\/li>\n<li style=\"text-align: justify;\">Cleaning activity services<\/li>\n<li style=\"text-align: justify;\">Banking and other financial services<\/li>\n<li style=\"text-align: justify;\">Foreign exchange broking services<\/li>\n<li style=\"text-align: justify;\">Airport services<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"color: #ff6600;\"><strong>NOTE:<\/strong><\/span>\u00a0<em>In the earlier regime, the services eligible for claim of refund were stipulated with certain conditions. But in the new regime the same has been done away with as there is no service specific classification prevailing under the law. However, it is advisable to follow to the extent possible all the conditions as were contained in the erstwhile regime as the same may be litigated by the department at the time of giving the refund.<\/em><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"color: #ff6600;\"><strong>PLACE OF REMOVAL<span style=\"text-decoration: underline;\">:<\/span><\/strong><\/span><span style=\"text-decoration: underline;\"><span style=\"color: #ff6600; text-decoration: underline;\"><strong>\u00a0<\/strong><\/span><\/span>Rebate of input service tax is allowed for services used beyond the place of removal. The definition of place of removal is contained in section 4 of Central Excise Act 1944.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>&#8220;Place of removal means &#8211;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>(i) A factory or any other place or premises of production or manufacture of the excisable goods;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>(ii) A warehouse or any other place or premises wherein the excisable goods have been permitted to be deposited without [payment of duty;]<\/em><\/p>\n<p style=\"text-align: justify;\"><em>(iii) a depot, premises of a consignment agent or any other place or premises from where the excisable goods are to be sold after their clearance from the factory;<\/em><\/p>\n<p style=\"text-align: justify;\"><em>from where such goods are removed;&#8221;<\/em><\/p>\n<p style=\"text-align: justify;\">Therefore, all services which are utilised beyond the place of removal are eligible to be claimed as input credit.<\/p>\n<p style=\"text-align: justify;\">One has to check in every case the meaning of place of removal in order to be eligible for refund of tax paid.<\/p>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"color: #ff6600;\"><strong>PROCEDURE FOR CLAIMING REFUND:<\/strong><\/span><span style=\"text-decoration: underline;\"><span style=\"color: #ff6600;\"><strong>\u00a0<\/strong><\/span><\/span>The Government of India issued a\u00a0Notification No. 41\/2012-Service Tax Dt. 29.06.2012 to enable the Exporter of Goods to claim the\u00a0Service tax what ever they have paid to effect the export of goods beyond the place of removal ( Factory ) to the port of export.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">Under the new notification, two procedures have been specified for claiming the refund of service tax. The first process allows rebate of service tax paid on eligible input services as a percentage value of the declared Free on Board (FOB) value of the export goods on the basis of rate specified in the schedule. The other procedure for rebate is the same as the procedure specified under earlier notification with minor changes.<\/p>\n<p style=\"text-align: justify;\">Now exporter of goods can get 100 % refund of service tax paid in the course of export on all the services used like\u00a0Agency Charge, Terminal Handling Charges (THC), Container Re-positioning Charges (REPO), B\/L Charges, C\/O Charges, Transportation, Stuffing Charges, Lashing Charges, Export Remittance Bank Collection Charges, Fumigation Charges, Loading Unloading Charges, ENS Filling, Seal Charges, Storage Charges, Survey Charges, Ground Rent Charges,\u00a0 Water Charges, Labor Charges etc \u2026\u2026\u2026\u2026..<\/p>\n<p style=\"text-align: justify;\">Exporter needs to simply fill up the attached FORM A 1 and submit to the excise division office. There are two way to claim the service tax refund as below \u00a0:-<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #33cccc;\">(A) Automatic Route<\/span> :-\u00a0 Under para\u00a02 (d)\u00a0of the above notification as under :- 2 (d)\u00a0The exporter shall make a declaration in the electronic shipping bill or bill of export, to the effect that\u2013<\/p>\n<p style=\"text-align: justify;\">(i) The rebate of service tax paid on the specified services is claimed as a percentage of the declared Free On Board(FOB) value of the said goods, on the basis of rate specified in the Schedule;<\/p>\n<p style=\"text-align: justify;\">(ii) No further rebate shall be claimed in respect of the specified services, under procedure specified in paragraph 3 or in any other manner, including on the ground that the rebate obtained is less than the service tax paid on the specified services;<\/p>\n<p style=\"text-align: justify;\">(iii) conditions of the notification have been fulfilled;<\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #33cccc;\">(B) Paper filling Route<\/span> :-\u00a0Under para 3\u00a0of the above notification as under :- if you are paying more service tax with compare to specified % under para 2 as above, you must file paper refund claim under this para to get 100% refund and it is so easy as Automatic route as above. for more details kindly log on to<\/p>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"color: #ff6600;\"><strong>Maximum amount of rebate allowed :<\/strong><\/span>The rebate under the procedure\u00a0on the basis of documents shall not be claimed wherever the\u00a0difference<strong>\u00a0<\/strong>between the amount of rebate under the procedure of and\u00a0rebate on the basis of documents\u00a0is\u00a0less than twenty per cent\u00a0of the rebate available under\u00a0the procedure of rebate as a percentage on FOB value of goods.<\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #ff6600;\"><strong>Time period for department to refund the amount: <\/strong><\/span>The Assistant Commissioner of Central Excise or the Deputy Commissioner of Central Excise shall refund the service tax paid on the specified service\u00a0<em>within a period of one month<\/em><strong><em>\u00a0<\/em><\/strong><em>from the receipt of said claim if he is satisfied that all the procedures as laid down in the notification have been complied with and that no refund has not been already received on the shipping bills or bills of export on the basis of procedure described in the notification.<\/em><\/li>\n<li style=\"text-align: justify;\"><span style=\"color: #ff6600;\"><strong>Time period for bringing foreign exchange currency in India<\/strong><\/span><span style=\"color: #ff6600;\"><strong> :<\/strong><\/span>Where any rebate of service tax paid on the specified services has been allowed to an exporter on export of goods\u00a0but the sale proceeds<strong>\u00a0<\/strong>in respect of said goods\u00a0are not received by or on behalf of the exporter,\u00a0in India, within the period allowed by the Reserve Bank of India under section 8 of the Foreign Exchange Management Act, 1999 including any extension of such period, such rebate\u00a0shall be deemed\u00a0<em>never to have been allowed<\/em>\u00a0and may be\u00a0recovered\u00a0under the provisions of the said Act and the rules made there under.<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><em>The content of this article is intended to provide a general guide to the subject matter.
