In the past times, it has been found that there have been instances where following malpractices have taken place at time of incorporation of Companies:<\/p>\n<ul>\n<li>A fictious address has been provided at the time of incorporation;<\/li>\n<li>Falsified documents being attached as proof of address<\/li>\n<li>Books and papers not being maintained at registered office of the company as per the requirement of legal provisions.<\/li>\n<\/ul>\n<p>To curb such malpractices Ministry of Corporate Affairs introduced a rule 25 B in the Companies ( Incorporation ) Rules, 2014 through Companies ( Incorporation ) Third Amendments Rules , 2022<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Powers_with_ROC_pursuant_to_rule_25_B_of_Companies_Incorporation_Rules_2014\"><\/span><span style=\"color: #000080;\"><strong><u>Powers with ROC pursuant to rule 25 B of Companies ( Incorporation ) Rules, 2014<\/u><\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<ol>\n<li>Power to cause physical verification registered office address of Company<\/li>\n<li>Power to seek assistance of Local Police: The Role on its discretion may take assistance from the local police. <strong><u>Note:-<\/u> <\/strong>ROC shall be accompanied by at least two independent witnesses of locality in which registered office is situated.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>Power to serve notice under section 248 of Companies Act, 2013 to directors, proposing striking off the name of companies from register of companies: Such a notice would be served by ROC where he believes that registered office address is not in a position of receiving acknowledging all communication and notices.<\/li>\n<\/ol>\n<h3><span class=\"ez-toc-section\" intimation of Registered office of the Company<\/li>\n<li>Non \u2013 Filing of E-form INC \u2013 20A i.e. Commencement of Business<\/li>\n<li>Any other reason \/ cause which ROC deems
