#000080;\"><strong>FIU-IND Registration Requirement VDA Service Providers with FIU-IND<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<h3><span class=\"ez-toc-section\" id=\"FIU-IND_Mandatory_registration\"><\/span><span style=\"color: #000080;\"><strong>FIU-IND <\/strong>Mandatory registration: <\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>In accordance with the Prevention of Money-Laundering Act, 2002 (PMLA) and the Prevention of Money-Laundering Rules (PMLR), registration with FIU-IND is a mandatory prerequisite for all Virtual Digital Asset Service Providers (VDA SPs) engaged in activities notified by the Central Government under Notification S.O. 1072(E) dated 7 March 2023.\u00a0 in case failure to register with FIU-IND, it shall be treated as a violation of the PMLA and may attract action under Section 13(2) of the PMLA, in addition to any other enforcement measures as may be applicable.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Purpose_of_registration_under_FIU_IND\"><\/span><span style=\"color: #000080;\"><strong>Purpose of registration under FIU IND <\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Registration with FIU-IND ensures the maintenance of accurate and comprehensive records of each Reporting Entity (RE), including:<\/p>\n<ul>\n<li>Details of the Designated Director (DD);<\/li>\n<li>Principal Officer (PO);<\/li>\n<li>Principal place of business; and<\/li>\n<li>Ownership and control structure, including significant beneficial ownership.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Initiation_of_Registration_under_FIU_IND\"><\/span><span style=\"color: #000080;\">Initiation of Registration\u00a0<strong>under FIU IND<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p><span style=\"color: #000080;\"><strong>Online initiation\u00a0under FIU IND<\/strong><\/span><\/p>\n<p>The registration process shall be initiated by the applicant VDA SP by registering its details on the FINGate portal. Upon successful submission:<\/p>\n<ul>\n<li>The application status will be displayed as \u201cAwaiting Approval\u201d;\n<ul>\n<li>A temporary Reference ID will be generated; and<\/li>\n<li>An acknowledgement email will be sent to the applicant.<\/li>\n<\/ul>\n<\/li>\n<li>Purpose of Reference ID : The Reference ID is generated only for reference and future correspondence with FIU-IND and does not constitute formal registration.<\/li>\n<li>Grant of formal registration : Formal registration shall be granted only after completion of the prescribed due diligence process, which includes Submission of all required documents;\u00a0An in-person meeting with FIU-IND (where applicable); and Final approval by the Director, FIU-IND.<\/li>\n<li>Issuance of FIU RE-ID : Upon satisfactory completion of the registration process, a FIU Reporting Entity Identification Number (FIU RE-ID) shall be generated and allotted to the applicant.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Submission_of_Documents_by_the_Applicant\"><\/span><span style=\"color: #000080;\"><strong>Submission of Documents by the Applicant<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The applicant VDA SP shall submit the prescribed documents and information, clearly stating:<\/p>\n<ul>\n<li>Whether the entity is currently operational (and the date of commencement), or<\/li>\n<li>Whether the entity is yet to commence operations \/ under development, along with an expected or tentative timeline.<\/li>\n<\/ul>\n<p>The in-person meeting, where required, shall be scheduled only after confirmation of operational readiness and submission of all required documents at least 15 days in advance.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"DocumentsInformation_Required_to_be_Submitted_for_FIU-IND_Registration\"><\/span><span style=\"color: #000080;\">Documents\/Information Required to be Submitted for FIU-IND Registration\u00a0<\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The applicant VDA Service Provider (VDA SP) shall submit the following documents and information as part of the FIU-IND registration process:<\/p>\n<p><span style=\"color: #000080;\"><strong>a) Business &amp; Ownership Details<\/strong><\/span><\/p>\n<p>a) Nature of Services Note : A brief note describing the nature of services offered and explaining how the applicant\u2019s activities fall within the scope of activities notified by the Central Government<\/p>\n<p><span style=\"color: #000080;\"><strong>b) Corporate Structure &amp; Ownership:\u00a0<\/strong><\/span><span style=\"color: #000080;\"><strong>A detailed corporate structure note, including:<\/strong><\/span><\/p>\n<ul>\n<li>Organizational chart (organogram); and<\/li>\n<li>Details of Significant Beneficial Owners (SBOs).<\/li>\n<li>Statutory &amp; Financial Records<\/li>\n<\/ul>\n<p><span style=\"color: #000080;\"><strong>c) Corporate Filings: Copies of:<\/strong><\/span><\/p>\n<ul>\n<li>Incorporation documents;<\/li>\n<li>Annual Returns;<\/li>\n<li>Balance Sheets; and<\/li>\n<li>Profit &amp; Loss Accountsfor the last three financial years, as filed with the MCA, along with details of the registered office and\/or principal place of business in India.<\/li>\n<\/ul>\n<p><strong><span style=\"color: #000080;\">d) GST Compliance Documents<\/span><\/strong><\/p>\n<ul>\n<li>GST registration certificates for all operating States\/UTs; and<\/li>\n<li>GST returns for the last three financial years, clearly indicating the nature of activities.<\/li>\n<\/ul>\n<p><span style=\"color: #000080;\"><strong>e) Income-tax &amp; TDS Records<\/strong><\/span><\/p>\n<ul>\n<li>Income-tax Returns; and<\/li>\n<li>Forms 26Q \/ 26QF \/ 26QE, as applicable, for TDS on VDA transactions.<\/li>\n<li>Contracts &amp; Business Relationships<\/li>\n<\/ul>\n<p><span style=\"color: #000080;\"><strong>f) Agreements with VDA Ecosystem Participants: <\/strong><\/span><\/p>\n<p>Copies of all domestic and international agreements\/contracts with:<\/p>\n<ul>\n<li>Exchanges;<\/li>\n<li>Brokers;<\/li>\n<li>Custodians;<\/li>\n<li>Intermediaries; or<\/li>\n<li>Other VDA SPs, along with a brief description of the scope and function of each arrangement.<\/li>\n<\/ul>\n<p><span style=\"color: #000080;\"><strong>g) PACT Certificate : <\/strong><\/span><\/p>\n<p>PACT (Partner Accreditation for Compliance and Trust) certificate obtained from FIU-IND registered VDA SPs with whom the applicant has existing or proposed business relationships (B2B, broker, intermediary, etc.).\u00a0Declarations &amp; Compliance Information<\/p>\n<p><span style=\"color: #000080;\"><strong>h) Self-Declaration on Legal Proceedings: A self-declaration stating that:<\/strong><\/span><\/p>\n<ul>\n<li>No proceedings have been initiated by or are pending with any law enforcement agency; and<\/li>\n<li>No criminal cases are initiated or pending against the applicant or its directors\/partners.\n<ul>\n<li>FIU-IND Questionnaire : A duly filled questionnaire issued by FIU-IND, covering various aspects of AML\/CFT\/CPF compliance. Cybersecurity &amp; Technology Controls<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"color: #000080;\"><strong>I) Cyber Security Audit Certificate : <\/strong><\/span><\/p>\n<p>A Cyber Security Audit Certificate issued by a CERT-In empanelled auditor, certifying compliance with: Applicable cybersecurity frameworks; and\u00a0CERT-In Directions dated 28 April 2022, issued under Section 70B(6) of the Information Technology Act, 2000.<\/p>\n<p>The audit must be comprehensive and risk-proportionate, covering all critical risk domains, and must certify whether the environment is secure to host and operate notified VDA activities.\u00a0The scope of the audit shall include, inter alia:<\/p>\n<ul>\n<li>Governance, compliance, access control, and insider risk;<\/li>\n<li>Infrastructure, network, and endpoint security;<\/li>\n<li>Application security and AML systems security, including:\n<ul>\n<li>KYC systems,<\/li>\n<li>Transaction monitoring,<\/li>\n<li>Wallet security,<\/li>\n<li>Cryptographic controls,<\/li>\n<li>Backup and recovery;<\/li>\n<\/ul>\n<\/li>\n<li>Third-party, cloud service, exchange, custodian, and API risks;<\/li>\n<li>Incident detection and response, including CERT-In reporting readiness.<\/li>\n<\/ul>\n<p><span style=\"color: #000080;\"><strong>J) Additional Information : Any other document or information as may be:<\/strong><\/span><\/p>\n<ul>\n<li>Specifically required by FIU-IND; or<\/li>\n<li>Voluntarily disclosed by the applicant to facilitate completion of the registration process.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Examination_of_Documents_by_FIU_officers\"><\/span><span style=\"color: #000080;\"><strong>Examination of Documents by FIU officers <\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>All documents and information submitted (in full and complete form) shall be examined by FIU-IND. If found satisfactory, the applicant shall be intimated regarding the scheduling of an in-person meeting.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"In-Person_Meeting_with_applicant_with_FIU_officer\"><\/span><span style=\"color: #000080;\"><strong>In-Person Meeting with applicant with FIU officer<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Purpose &amp; Attendance in-person meeting with FIU officer : \u00a0The in-person meeting is conducted to assess and verify the AML\/CFT\/CPF compliance framework, systems, tools, and processes implemented by the applicant.
