Income Tax Bill, 2025 empowers for tax authorities to access digital platforms

The proposed Income Tax Bill, 2025, introduces expanded powers for tax authorities to access various digital platforms as social media accounts, emails, and online financial accounts during investigations into suspected tax evasion. This includes the authority to override access codes to computer systems and virtual digital spaces, which encompass email servers, social media accounts, banking and trading accounts, and cloud servers. It has raised significant concerns regarding potential infringements on the fundamental right to privacy. Legal experts have highlighted issues related to constitutional validity, potential state overreach, and challenges in practical enforcement. Key Concerns on Provisions of the Income Tax Bill, 2025:

  • Access to Computer Systems: Tax authorities can demand access to electronic records, emails, and social media accounts in cases of suspected tax evasion.
  • Overriding Access Codes: If individuals refuse to provide passwords or security codes, tax officials can bypass digital security to access data.
  • Expanded Definition of Virtual Digital Space: The bill explicitly includes emails, bank accounts, investment portfolios, trading accounts, and cloud storage within the scope of digital assets that can be searched.
    • Broad and Vague Definition of Virtual Digital Space: The new bill’s expansive definition of VDS encompasses various digital realms, potentially allowing for extensive surveillance without clear boundaries.
    • Expanded Definition of Virtual Digital Space: The new bill defines “virtual digital space” as an “environment, area or realm that is constructed and experienced through computer systems.” This broad definition explicitly includes:
      • Social media accounts
      • Personal emails
      • Bank accounts
      • Trading and investment accounts
      • Cloud servers
  • Evolving Tax Evasion Techniques: The use of smart, internet-based tools for concealing income and assets has prompted the tax department to modernize its enforcement strategies. By encompassing these digital platforms, the bill acknowledges the evolving nature of financial transactions and communications, ensuring that tax authorities can access pertinent digital records during investigations.
  • Potential State Overreach: The enhanced powers could lead to arbitrary or excessive intrusions into individuals’ private digital lives, raising concerns about misuse and lack of proper oversight.
